Bevin: Kentucky to Join Suit Against Obama's Bathroom Order
Kentucky will join the 11 other states suing the Obama Administration over a federal directive related to bathrooms, Governor Matt Bevin announced on Friday.
“The federal government has no authority to dictate local school districts' bathroom and locker room policies,” said Bevin. “The Obama Administration’s transgender policy ‘guidelines’ are an absurd federal overreach into a local issue.”
“Unfortunately, Attorney General Andy Beshear is unwilling to protect Kentucky’s control over local issues. Therefore, my administration will do so by joining this lawsuit. We are committed to protecting the Tenth Amendment and fighting federal overreach into state and local issues.”
President Barack Obama's administration made the order two weeks ago. The New York Times reported:
Although transgender rights have been litigated for years, the issue shifted into the public consciousness, in part because of the May 13 directive from the Department of Education and the Justice Department that a school “must not treat a transgender student differently from the way it treats other students of the same gender identity.”
The government also said that a school had an obligation “to provide transgender students equal access to educational programs and activities even in circumstances in which other students, parents or community members raise objections or concerns.” The officials added that “the desire to accommodate others’ discomfort cannot justify a policy that singles out and disadvantages a particular class of students.”
The Republican President of the Kentucky Senate also applauded the move. “I commend Governor Bevin for joining the lawsuit against the Obama Administration’s recent decision, based upon an unprecedented expansion of a law enacted in 1972, to issue transgender policy guidelines regarding the use of local school district bathrooms and locker rooms," Stiver said in a statement.
“I also urge Attorney General Beshear and House and Senate Democrats to support the federal lawsuit to protect local control of Kentucky schools from federal overreach and Tenth Amendment violations. We must stand with Governor Bevin in opposing strong-arm tactics of the Obama Administration. Those tactics threaten the removal of taxpayer funds to compel Kentucky schools to conform to novel and dubious interpretations of federal law.”
